Pegasus Reiterreisen/Equitour AG (hereinafter referred to as Equitour) collects and stores personal data in connection with a catalogue order, a travel booking and/or the desire to receive our newsletter. This is all information that relates to an identified or identifiable natural person (and not to a legal entity such as a company).

As part of our commitment to protect your personal data in a transparent manner, we would like to inform you of the following:

- why and how Equitour collects, uses and stores your personal information,
- the legal basis for the processing of your personal data and
- Your rights and our obligations with regard to this processing.

2. what types of personal data do we collect for booking a trip?

Personal information such as name, date of birth, height and weight for the appropriate allocation of horses, telephone number, address and e-mail address, nationality for visa information as well as details of your fellow riders, which you register on this form.

3. on what legal basis and for what purposes do we process personal data?

3.1 Legal basis for the processing
Depending on the purpose of the processing activity (see point 3.2), the legal basis for the processing of your personal data is one of the following:
(I) necessary to safeguard the legitimate interests of EQUITOR without unduly affecting your interests or fundamental rights and freedoms (see below),
(II) necessary for the initiation or conclusion of a contract with you for the services or products requested or for the performance of our obligations under such a contract, e.g. if we use your data for the purposes set out in Sections 3.2(a), (b), (c) and (j) below (as well as for certain of the data disclosure options described in Section 4),
(III) necessary to comply with our legal or regulatory obligations, including, but not limited to, the audits referred to in 3.2(a) below and the disclosures to governmental, regulatory and governmental agencies referred to in 3.2(g) and 4 below,
(IV) where the use of special categories of personal data is necessary for the exercise or defence of legal claims or the processing relates to personal data that are manifestly in the public domain;
(V) in a few cases, your personal data will be processed with your consent, which we will obtain from you in each case (e.g. when required by laws other than the EU DSGVO), or with your express consent in the case of special categories of personal data, such as age, height and weight.
Examples of the 'legitimate interests mentioned above' are
- the pursuit of specific purposes from points 3.2(a) to 3.2(d) below,
- the exercise of our rights under Articles 16 and 17 of the Charter of Fundamental Rights, including the freedom to conduct a business and the right to property
- upon disclosure in accordance with the following section 4, to provide products and services and to ensure a consistently high standard of service in EQUITOUR and the satisfaction of our customers, employees and travel (service) partners.
- the fulfilment of our accountability obligations and regulatory requirements,
in each case under the condition that your data protection interests do not outweigh these interests.
If the personal data that we collect from you is required to fulfil our legal or regulatory obligations or to conclude a contract with you, we may not be able to accept you as a customer or provide you with products or services if we cannot collect this personal data (in which case we will inform you accordingly).
3.2 Purposes of processing
We always process your personal data for a specific purpose and only process the personal data relevant to achieving this purpose. We process personal data in particular for the following purposes:
a) to provide products and services to you and for their proper execution, for example by ensuring that we can identify you
b) to manage our relationship with you, including communication with you regarding products and services purchased from us and our business partners, to handle customer service related questions and complaints

c) for measures to improve our products and services and the technologies we use, including reviewing and updating our systems and processes, and for market research purposes to find out how we can improve our existing products and services or what other products and services we can offer
d) for any other purpose of which we inform you in each case.

4) Who can access personal data and to whom is it passed on?

4.1 Within Equitour AG

Your personal data is stored exclusively within the company in the secure data area and can only be viewed by the employees.

4.2 Service provider

Usually we only pass on personal data to third parties in order to ensure the smooth processing of a trip you have booked, i.e. name, year of birth, height, weight and riding skills. This information allows us to make proper reservations for services such as hotel rooms etc. and to allocate suitable horses.
The recipients mentioned in the above point 4.2 may also be resident outside Switzerland. In this case EQUITOUR requires that these recipients take appropriate measures to protect personal data, which are set out in a binding legal agreement. A copy of these measures can be obtained from the Data Protection Officer ("DPO") at the address given at the end of this Privacy Notice.

4.3 Other

- In the event that we sell our business to another company or restructure our business, personal information will be shared to continue to provide you with products and services.
- We may need to disclose personal information in order to exercise or preserve legal rights, including our legal rights and the legal rights of our employees, or to respond to requests from individuals or their representatives who wish to preserve their legal rights or the legal rights of others.

We only store personal data for as long as necessary to fulfil the purpose for which it was collected or in accordance with legal, supervisory or internal regulations. To this end, we apply criteria to determine the reasonable periods of time for which your personal data may be retained, depending on the purpose of the data, such as the proper handling of a trip, facilitating client relationship management and responding to legal claims or regulatory inquiries.

5. your rights

You have the right to request that Equitour rectify any inaccurate personal data that we collect and process; you also have the right to request a restriction on the processing of your personal data for as long as such a request is under consideration.
If we process your personal data with your consent, you have the right to withdraw such consent at any time. Please also note that the revocation of your consent does not affect the lawfulness of the processing prior to the revocation, which took place with your consent.
You have the right to ask us to stop processing your personal data or to delete your personal data; these rights are not unlimited rights (as there may sometimes be overriding interests, for example, that require further processing), but we will consider your request and inform you of the result. If personal data are processed for direct marketing (newsletters) purposes, your right to object also extends to direct marketing, insofar as the latter is related to such marketing. If you wish to exercise your right to withdraw from direct marketing, please click on "unsubscribe" in any of our newsletters sent to you or contact us at the address in point 6.
To exercise the above rights, you may contact the DPO via the contact details set out in paragraph 8 of this Privacy Notice.

6. exercising your rights and complaints

If you are not satisfied with any aspect of the processing of your personal data by Equitour, we will be happy to discuss this with you in order to find a solution. You may exercise any of your rights in relation to your personal data by writing to one of the following addresses. In order to avoid any delay in dealing with your request, we would like to ask you to enclose a copy of your passport or identity card with your signed letter:

If you are not satisfied with Equitour AG's response, you have the right to complain to the data protection authority in the jurisdiction where you live or work, or at the location where you believe a problem with your data has arisen.

7. security advice

We have taken appropriate technical and organisational measures to prevent unauthorised or unlawful access to the personal data you have provided us with. Since complete data security cannot be guaranteed for communication by e-mail or instant messaging or similar means of communication, we recommend that you choose a secure shipping alternative for particularly confidential information.

8. storage periods:

As a rule, Equitour stores personal data for the duration of your business relationship (your trip) or your contract with Equitour and for another 3 years thereafter. For the purpose of direct marketing (newsletter) we store your address until your cancellation, but for a maximum of 10 years. Ongoing or anticipated legal or regulatory proceedings may result in storage beyond this period.
